1] The Applicant, a young boy aged 20 years, is charged with the
offence punishable under Section 306, 376(2)(1), 504, 506 of the Indian
Penal Code read with 4 and 8 of the Protection of Children from Sexual
Offences Act, 2012. He came to be arrested on 06.03.2021 when the
subject CR No.56/2021 was registered on the complaint lodged by the
mother of the deceased.

2] In the exhaustive complaint lodged by the mother of a minor girl
aged 16 years, 3 months, 28 days, she states that the deceased had
passed her 10th standard and was admitted in a college in Mulund and
persuading her education in 11th Standard. She had disclosed to her
mother that she had developed friendship with a boy through Instagram

and it was narrated by her that he was harassing her. On 27.02.2021
the complainant called the Applicant to her house and asked him not to
indulge with her daughter. On 02.03.2021, it is alleged that, the
deceased was abused by the Applicant, as a result of which she was
disturbed. On 03.3.2021 she hanged herself in the bedroom pursuant
to which the mother of the victim lodged the complaint and CR was
registered. Her mobile phone on being checked refer to WhatsApp
chat with the Applicant at 8.55 p.m. and this refer to a result of
pregnancy kit, where the deceased girl expressed her apprehension
about she having been conceived and she tried to find solution with the
Applicant, but it appears that he was unbothered and had used
abusive language.

3. I have heard Mr.Jha, the learned counsel for the
Appellant and the Mr.Singh, the learned Additional Solicitor
General for the Respondent-State. With the assistance of the
learned counsel for the parties, I have gone through the record.

4. According to the case made out in the plaint, the
Appellant has purchased 5553 sq.mts. of land, in an auction

conducted in pursuance of a mortgage in favour of the Bombay
Mercantile Co-operative Bank Ltd. The suit land is bearing TPS

(ii) Insofar as Arbitration Petition No. 3 of 2019 is concerned,

Mr. Sadashiv S. Deshmukh, Former District Judge is appointed as

a sole arbitrator to adjudicate the disputes between the parties

which have arisen under the Agreement in question.

(iii) The learned sole arbitrator, before entering the arbitration

reference, shall forward a statement of disclosure as per the

requirement of Section 11(8) read with Section 12(1) of the

Arbitration and Conciliation Act,1996, to the Prothonotary &

Senior Master of this Court, to be placed on record of this

application with a copy to be forwarded to both the parties;

2. The project in question is something called Integrated ‘Arya’
at village Kirol, Narayan Nagar, Ghatkopar West, Mumbai 400 086.
The Petitioner is concerned with one flat. We are told that this is flat
C-501, i.e., flat No. 501 on the fifth floor of Wing ‘C’. This is not a

free sale building but is a rehab building to which the Petitioner is
entitled. That is undisputed. It is also undisputed that the Petitioner
is presently in transit accommodation being paid for and provided by
the 3rd Respondent, Integrated Spaces Limited.

1. Applicants are real brothers. Due to their first unsuccessful
attempt to secure pre-arrest bail before the Sessions Court, they
approached this Court.

2. The first informant and the victim is one Mahesh Paithankar.

The applicants and the victims are residents of Shivaji Nagar,
Malegaon, Tal. Baramati, Dist. Pune. The incident in question
had occurred on 10th July, 2022 at around 7.30 p.m.

3. Allegations as apparent from the First Information Report
dated 11th July, 2022 are that when the victim along with one
Abhay Chaware and Rajendra Paithankar was taking snacks on
account of fast and was about to leave the said shop, all of a
sudden, prime accused Swapnil Deulkar rushed to him and
inflicted a blow of scythe on his head from the rear side as well
as on his back. Due to the sudden assault, victim sustained
grievous injuries to his head and back. He fell down. The first
information report further reveals that while escaping from the

spot, the assailant Swapnil threatened the first informant that
he (victim) should not antagonize the applicants, else, he
would eliminate him.
